This is a Multi-Par Auction. The parcels will be offered in individual parcels, in any combination of parcels, or as a total unit.
PARCEL 1 INFO: 35 Acres +/-, includes 3,975 sq. ft. prairie ranch-style house with log & timber frame and stone construction. Includes a 60' x 90' indoor riding arena with 24' x 12' block tack room, several horse paddocks and irrigated pasture. AUCTION PROCEDURE: The parcels will be offered in individual parcels, in any combination of parcels, or as a total unit. There will be open bidding on all parcels and combinations during the auction as determined by the auctioneer. Bids on parcels, parcel combinations, and the total property may compete. The property will be sold in the manner resulting in the highest total sale price, subject to the sellers acceptance or rejection.

DOWN PAYMENT: A $25,000 earnest money deposit will be required for each individual parcel. All parcels are offered ”subject to the seller's approval” of final bid price. On parcels 2 & 3, seller will offer financing to any buyer with a minimum of $50,000 down and the balance of the purchase price amortized over a fifteen year period with an interest rate of 6%. There will be a balloon payment at the end of five years. All parcels are subject to being sold prior to auction. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, SO BE SURE YOU HAVE ARRANGED FINANCING, IF NEEDED, AND ARE CAPABLE OF PAYING CASH AT CLOSING, OR ACCEPTS THE SELLER FINANCING PROVIDED ABOVE.
APPROVAL OF BID PRICES: All successful bidders will be required to enter into purchase agreements at the auction immediately following the close of the auction. The auction bids are subject to the acceptance or rejection by the Seller.
DEED: Seller will provide Warranty Deed(s).
EVIDENCE OF TITLE: The Seller agrees to furnish an Owner's Policy of Title Insurance in the amount of the purchase price by Park County Title, Cody, WY.
CLOSING: The balance in cash or certified funds on or before September 30th, 2010.
POSSESSION: Possession at closing.
REAL ESTATE TAXES: The taxes will be prorated to the date of closing between the buyer and the seller. The 2010 water assessment to the Heart Mountain Irrigation District will be paid by the seller.
SURVEY: Seller shall provide a survey for any parcel where there is no existing legal description or where new boundaries are created by the parcel divisions in this auction. Any need for a new survey shall be determined solely by the Seller. Seller shall each pay 100% of the cost of the survey. The type of survey performed shall be at the Seller's option and sufficient for providing title insurance. Closing prices shall not be adjusted to reflect any difference between advertised and surveyed acres.
ACREAGE AND PARCELS: All acreages are approximate and have been estimated based on current legal description and/or aerial photos. Any corrections, additions, or deletions will be made known prior to the auction.
